PERIODIC INSPECTIONS OF PARKING STRUCTURES

LOCAL LAW 126

NEW PERIODIC INSPECTIONS REQUIREMETS FOR NYC PARKING STRUCTURES ARE IN FULL EFFECT AS OF JANUARY 1, 2022.

TO KEEP BUILDINGS SAFE, OWNERS OF PARKING STRUCTURES OPEN OR ENCLOSED AS DEFINED IN THE NYC BUILDING CODES SHALL HIRE A PROFESSIONAL ENGINEER TO  INSPECT THE STRUCTURE EVERY SIX (6) YEARS AND FILE A CONDITION ASSESSMENT REPORT WITH THE DEPARTMENT OF BUILDINGS. THIS DOES NOT INCLUDE AUTOBODY/AUTOMOTIVE (REPAIR SHOP, SHOWROOMS, SERVICE STAIONS), GARAGES THAT HOLD FEWER THAN THREE (3) CARS, UNENCLOSED/ UNATTACHED OUTDOOR PARKING LOTS OR PRIVATE GARAGES SERVING ONE (1) AND TWO (2) FAMILY HOMES.

DOB NOW NEW  OWNER / OWNER REPRESENTATIVE E-FILING REGISTRATION

  •  Fill out the Authentication Form (also called Electronic Filing Account Information) online.  To complete the form, you will need to provide your contact information and create a password.

  • Submit

  • Check email for confirmation of e-filing account. Click on the link in the email.

  • Check email for Instructions on how to log into the e-filing account. 

INSPECTION AND REPORT DEADLINE

The parking structure report and maintenance/repair deadlines are divided into cycles, which are further subdivided into three sub-cycles. The Community District in which the Parking Structure is located determines if the property falls into sub-cycle A, B, or C. See Cycle 1 Sub-Cycle Diagram.

For parking structures in:

  • Manhattan Community Districts 1, 2, 3, 4, 5, 6, 7: January 1, 2022 - December 31, 2023

  • Manhattan Community Districts 8, 9, 10, 11, 12 and Brooklyn Community Districts: January 1, 2024 - December 31, 2025

  • Bronx, Queens, and Staten Island Community Districts: January 1, 2026 - December 31, 2027

GARAGE CLASSIFICATIONS

 Garage inspections also called critical examinations must be performed by a Qualified Parking Structure Inspector (QPSI). QPSI's are Professional Engineers (PE) and Registered Architects (RA) with a New York State license. After an inspection is completed, the QPSI must file an written report with the Department of buildings.  Based on the garage's condition, the building/structure can be classified with one of three ways: Safe, SREM, or Unsafe

FILING FEES

UNSAFE conditions must be corrected within 90 days of filing a report with a UNSAFE status.
An AMENDED report must be filed within 2 weeks of completing repairs
